TERMS OF USE

TERMS OF USE BELOW MUST BE READ BEFORE USING THIS SITE AND THE APP. THE USAGE OF THIS SITE AND THE APP INDICATES ACCEPTANCE OF THE TERMS AND CONDITIONS BELOW.

www.tripdixi.com (Site) and Tripdixi application (App) is managed and owned by Tripdixi (we, us, or our). By accessing and/or use of this Site and the App, you acknowledge that you have read and understood, and agree to the Terms of Use stated below and other terms and conditions in relation to this Site and the App, including but not limited to confidentiality and FAQs, which an integral part of these Terms of Use (Terms). You must be at least 18 (eighteen) years old to use this Site and the App.

We based on our policy may change and modify these Terms at any time without prior notice. By continuing to use this Site and the App after such changes to these Terms, visitors or Registered Users (you or user) agree and consent to the changes.

1. OUR SERVICES

1.1. Tripdixi through the Site provides an online platform where you can browse various trips (Services) all across Indonesia as well as through the App. Users can make bookings of services provided by tour operator or travel agency (Vendors) only by the App. We will provide a booking confirmation via email and short message service (sms). We reserve the right to refuse the booking for reasons set forth below.

1.2. We have the right to not accept any user or booking (or in certain cases cancel the booking confirmation) at our sole discretion and for any cause without giving reasons for the rejection/refusal/cancellation. The reasons for rejecting a user or booking or cancelling a booking confirmation may include but are not limited to: breach of these Terms, trade or economic sanctions by global or national authorities, embargo, prohibitions in regulations, fraud or theft (or indication or suspicion of fraud or theft), suspicion of criminal activity, suspicious ordering, services not being available or no longer being made available by the Vendor, user providing inaccurate, erroneous or misleading information, problems with credit card electronic communications, information or transactions, inappropriate behavior, threats, insults, refusal to provide information, practical impediments, communication difficulties or breakdowns, a Real Mistake (hereinafter described below), history of breaches of these Terms, or being placed on any “black lists” or “watch lists” by governments or international organizations. In case the booking is rejected or cancelled by Tripdixi and payment has been made, Tripdixi shall reimburse the amount already charged without additional charges. We can at anytime delete or remove (Removed) membership of the user of the App, either temporarily or permanently. Removed Users are prohibited to attempt using the App in any other name or through other users (hereinafter described in the Fraud Prevention Mechanism condition).

1.3. In a particular case, we may cancel or reject reservations with respect to the “Real Mistake”, which does not depend on where the error originated. A Real Mistake is a fault on the App (for example: in terms of price, in terms of availibility, minimum pax) which no reasonable person would consider appropriate or to make business sense. The amount charged shall be reimbursed without further charges in such a case.

2. CANCELLATION POLICIES

2.1. By making a booking through the App, you accept and agree to the terms and conditions of applicable Vendors, including policies regarding cancellation, refund, or your specific requests which may be given to the Vendors. We are not responsible for any violation of these terms and conditions which are agreed on between the Vendor and the user, or which are based on the user’s specific requests, so please read the Vendors’ terms and conditions carefully.

2.2. Regarding refunds, Tripdixi maybe able to withhold or take some part amount from the paid amount to reimburse the costs that have been incurred in connection with the cancellation as a administration or bank fee.

3. SPECIAL REQUESTS

3.1. In you have any special requests (for example: non smoking room, vegan foods, personal porter, assistant for special need) you can insert the request when making a booking on the App or contact the Vendor directly (after payment has been made). The request will be addressed directly to the Vendor, based on availability and other factors. Your special requests maybe subject to additional charges and/or fees by the relevant Vendor based on the discretion and/or policy of the relevant Vendor. Tripdixi is not responsible for the availability and/or fulfillment of your special requests by the Vendor.

3.2. In the event of rescheduling (including but not limited to changes of date, changes of pax) by the user, Tripdixi does not guarantee the availibility of the new request. And for that case, user can cancel the booking where the cancellation policies will be applied.

4. TRAVEL ADVICE

4.1. By displaying particular destinations, Tripdixi does not represent or warrant that travel to such points is advisable or risk-free and Tripdixi must not be held liable for damages or losses that may result from travel to such destinations. Under no circumstances shall Tripdixi be held liable for any adverse incidents occurring during your trip. You are personally responsible for the selection of service for the entire duration of your trip. Tripdixi is not responsible for any loss that occurs when you fail to bring required travel documents, such as your identification card, passport and any other reasons caused by your willful misconduct and/or negligence. Tripdixi not responsible for any willful misconduct and/or negligence caused by the Vendor as well.

4.2. Tripdixi has no obligation and shall not be responsible to notify you of the trip arrangements and permits necessary for you to be able to carry out your trip plans. Tripdixi reserves its right to limit its liability in the case of any losses or damages arising out of or in relation to your trip permits.

5. RATINGS

5.1. Ratings shown on the App are only provided for the information of users only, and existing ratings are based on information given by users. We do not verify the rating given and are therefore not responsible for the accuracy of the existing rating. We hereby declare denial of any claims, losses or liability with respect to the ratings shown on the App.

6. PRICE AND PROMOTION

6.1. We may offer lower prices and/ or promotions from time to time. Please note that these may involve different conditions and requirements as it relates to booking and refund policies.

7. REFUNDS

7.1. User can cancel the booking at any time before the final confirmation is done or after making payment based on cancellation policies. Prices shown are detailed so that users can see the amount to be paid, any additional costs due to the use of credit cards or inter-bank fees charged for the transaction fees will be covered by Tripdixi. For every cancellations, Tripdixi will work with you to refund amounts already paid by you, reduced by the costs incurred by Tripdixi, e.g. inter-bank transfer fees. Refunds may not be immediate depending on your initial mode of payment. You can contact Tripdixi customer service (during customer service operational hours) for further details on the estimated duration for receiving your refund and we will assist you as best as we can. Please note that there are a condition that refund can’t be made based on services policies.

7.2. Tripdixi shall not be held responsible or liable for any cancelled issuing of booking confirmation or other transactions caused by inaccurate transfer amounts, or exceeding the time limit for transfers. For real-time inter bank transfers, you must use an ATM. After completing the inter-bank transfer, please confirm your payment immediately by filling in the payment confirmation form.

8. USER ACCOUNT

8.1. For registration purposes, we will collect and process your personal information, such as your name, age, nationality, electronic mail (e-mail) address, and your mobile phone number when you register. You must provide us with an accurate, complete, and latest information and agree to provide us with any proof of identity that we may reasonably request.

8.2. Only you can use your own account and you represent and warrant that you will not authorize any other party to use your identity or your account for any reason, unless by written permition by Tripdixi.

8.3. You must maintain the security and confidentiality of your account password and any identification we provide to you. In the event of any disclosure of your password, in any way whatsoever resulting in any unauthorized use of your account or identity, order(s) received from such unauthorized use shall still be considered as valid orders and we will process such order(s). You hereby declare that Tripdixi is not responsible for any loss or damage arising from the misuse of your account.

8.4. If you no longer have control or access to your account, you are required to immediately notify us (e.g., your account is hacked or your phone is stolen) so we can temporarily block and/or inactivate your account properly. Please note that you are responsible for your use of your account and may be liable for your account even if your account is misused by others.

9. PAYMENT DETAILS AND PROCEDURES

9.1. Payments are made in the amount and currency as stated including bank fees or any other charges by Tripdixi.

9.2. For all forms of booking, you must make payment within the specified time limit and amount. If the payment is not made or not specified amount, then Tripdixi reserves the right to cancel the booking.

9.3. Payment methods include but are not limited to bank transfer and credit card. For payment by bank transfer, you must provide the bank transfer receipt as proof of payment of booking listed in the Tripdixi confirmation email. You must follow the procedures stated in the confirmation email.

10. CREDIT CARD PAYMENT AND FRAUD

10.1. For payment of bookings placed through the App, your credit card will be billed by Tripdixi for the full price at the time of booking and confirmation of the booking. You must check the booking details thoroughly each time before you make a payment.
10.2. For certain cases, you maybe have to pay directly to the Vendor.

10.3. In order to safeguard and encrypt your credit card information when in transit to us by our payment gateway partner, our payment gateway partner use encryption technology such as Transport Layer Security (TLS) or Secure Sockets Layer (SSL) or 3D-Secure (3D-S) to ensure the integrity of your information. Any changes or procedure regarding encryption technology belong directly to our payment gateway partner.

10.4. In the case of credit card fraud or unauthorized use of your credit card by a third party, you must contact your bank or card issuer immediately after realizing such unauthorized use. In that case, Tripdixi takes no responsibility over any case of credit card fraud or unauthorized use of your credit card by a third party, regardless of whether such fraud or unauthorized use was carried out through Tripdixi services or mistakes with clear evidence.

10.5. Tripdixi is not obliged to make refunds to you as a result of such fraud. As part of our goodwill, we may provide a form of compensation to you subject to review and approval by us. You shall only be eligible to request compensation only if such booking have been made through the App and our payment gateway partner secure servers and the fraud or unauthorized use of your credit card is a result of our default or negligence and through no fault of your own while using the secure server.

10.6. If you suspect any unauthorized booking or fraud committed on Tripdixi, you must contact our Customer Service team immediately.

11. USER CONTENT RIGHTS

11.1. By completing a trip, you hereby agree to receive electronic mail containing an invitation to provide fair reviews based on your personal trip experience to your Vendor. Tripdixi has sole discretion whether your review will appear on the App or not. Tripdixi have a right to display the review, which may contain comments, satisfaction rate and your name.

11.2. Your content review shall not contain confidential information and Tripdixi shall have no obligation to treat the content review as confidential information.

11.3. Tripdixi has sole discretion to use the content review as deemed appropriate, including but not limited to removing, cutting, modifying, or otherwise editing the review without reducing the intent of the review.

11.4. We shall have no obligation to pay for your submitted review, including but not limited to content review that has been changed, eliminated or modified.

12. USAGE RESTRICTIONS

12.1. You hereby agree to not use this Site or the App or the Content for unlawful or unauthorized activity or commercial purpose. You agree that you will not use any equipment, software, or other technologies that may obstruct or attempt to obstruct the operation of this Site and the App.

13. INTELECTUAL PROPERTY RIGHTS

13.1. This Site and the App contains Tripdixi’s Intellectual Property, including but not limited to text, software, photos, graphics, video, music and sound. The whole of this Site’s and the App’s content is protected by copyright laws. You must not modify, reproduce, copy, perform, display, publish, or exploit the Content, in whole or in part, without written consent from Tripdixi.

13.2. Tripdixi in making this Site and the App, preparing the source code and performing software support, can license the use of open source software from third parties through the GNU General Public Licence (GPL). Any use by Tripdixi of open source software and the intellectual property rights of a third party are with the necessary licences or permits.

14. FORCE MAJEURE

14.1. Tripdixi shall not be liable for any non-performance or violation of these Terms, such as for transaction failure, restricted access to this Site and the App, or any damage or harm to users caused by any act or condition beyond the reasonable control of either You or Us (Force Majeure Event). Force Majeure Events include but are not limited to natural disaster (floods, earthquakes), epidemic, riot, a declaration of war, war, military action, terrorist action, embargo, sanctions, changes in laws or regulations, lightning, hurricanes / typhoons / cyclones, labor strikes, demonstrations, airline or hotel bankruptcy or insolvency, and so forth.

14.2. Tripdixi shall not be responsible for any damages or losses caused by any means to any party if Tripdixi cannot process your booking because of the Force Majeure Event.

15. TERMINATION

15.1. Tripdixi has sole and full discretion to change, postpone, discontinue or stop this Site and the App and/or part of this Site and the App, including services or products that are made available in this Site and the App, and/ or usage of this Site and the App, or part thereof, at any time for any reason without prior notification to you.

15.2. Tripdixi shall not be liable to you or any third-party for any termination or suspension of your access to the Site.

16. GOVERNING LAW

16.1. These Terms shall be governed by and interpreted in accordance solely with the Laws of Republic of Indonesia.
